MGB-10 files Criminal Charges against Manalo Mining Group

MGB-10 files criminal charge against Manalo Mining Group for “Theft of Minerals” under R.A. 7942, otherwise known as the Philippine Mining Act of 1995 on April 13, 2009.  The crime is punishable upon conviction by imprisonment from six (6) months to six (6) years plus fine. The Office will also confiscate all equipment, tools and conveyance used in the illegal mining activities.

Prior to the filing of the aforesaid criminal case by MGB -10, the following is the chronology of events:

Sometime in late July 2008, Pastor Semilla, representative of the Manalo Group, went to MGB-10 and informed the office that they are applying for a Small Scale Mining Permit (SSMP), however, they lack the social acceptability certification from the LGU Opol. The Manalo Group has also informed MGB-10 that they have already acquired consent from Eastwind Mining, which they believed has the ExPA over their mining operation is located. Thus, as per advised by LGU Opol, they are seeking for MGB certificate that they have already complied the MC 2007-07. To provide assistance to the clientele, MGB-10 immediately conducted field verification on August 5, 2008.

 

“OPLAN HULI” UP AGAINST HYDRAULICKING OPERATORS

oplan huliIn a bid to stop all illegal hydraulicking operations within the Iponan River Watershed, a team composed of forty five(45) personnel from MGB 10, CENRO-Initao, 4th Infantry Division/Philippine Army, NBI 10, 10TH PNP Regional Mobile Group and Opol PNP Station was commissioned to conduct “Operation Huli” on February 13, 2009. This activity was hatched by the Technical Working Group of the Regional Minerals Development Council chaired by OIC RD Juanito A. Manzano, Jr of MGB-10, after a series of meetings held at DENR Region 10. The recurring problem of heavy siltation of Iponan River due to absence of forest vegetation and hydraulicking was believed to be a contributory factor to the flooding that recently hit Cagayan de Oro City.

Slope Failure Damaged 1 House, Several at High Risk

slope failureDue to heavy downpour of rain on July 25, 2008 that lasted until 3 am the following day, a slope failure (rock topple) occurred at Phase 3 of Abigail Homes in Brgy. Del Carmen, Iligan City. The failure happened on July 26, 2008 at around 2 o’clock in the morning. 1 house located near the slope was severely damaged forcing the occupants, Flauta Family, to evacuate immediately. The perimeter fence of the subdivision was also partially destroyed. The event was brought to the attention of MGB-10 by Mr. Allan B. Padilla, Acting Civil Defense Deputized Coordinator of Iligan City Disaster Coordinating Council through the Office of the Regional Disaster Coordinating Council. In response, a technical team from MGB-10 was dispatched on August 2, 2008 to assess the said event.

 

Bulua Landslide Affected 2 Houses

bulua landslide1The landslide in Zone 7, Upper Villa Candida, Brgy. Bulua, Cagayan de Oro City on August 23, 2008, completely damaged one house owned by Ms. Charlene Lesio and partially damaged another. Fortunately, no casualties were reported.

Assessment conducted by MGB-10 geologists revealed that there are approximately 30 residences located along this very steep slope in the vicinity of the landslide affected area. Slope gradient along this side of the hill reach up to 70° in angle.

A tunnel was also noted at the base of the hill, adjacent to the landslide area. Local residents say that this tunnel connects to an opening located at the top of the hill.
