EXPLORATION PERMIT APPLICATION

Checklist

  1. Mandatory Acceptance Requirements
  1. Application Form (MGB Form No. 5-1)
  2. For corporation/partnership/association/cooperative:  SEC/CDA-certified Certificate of Registration, Articles of Incorporation/ Partnership/Association and By-Laws; or a Certification from MGB CO/RO concerned that such documents are duly registered in that Office (note: with minimum authorized capital of P10M and paid-up capital of P2.5M)
  3. Location Map/Sketch Plan (1:50,000 NAMRIA topographic map) showing coordinates/boundaries (in tabulated form) with major environmental features/other projects (prepared, sealed and signed by a deputized Geodetic Engineer)
  4. Two (2)-Year Exploration Work Program  (MGB Form No. 5-4), duly prepared, signed and sealed by a licensed Mining Engineer or Geologist
  5. Proof of technical competence in the form of:  Bio-data and track records in mining operations/ environmental management  Sworn commitment of the technical person(s) who will undertake the implementation of the Work Programs/joint sworn commitment of the technical person(s) and the company/proof of availed services of the technical person(s)
  6. Proof of financial capability in the form of:  Latest audited Financial Statements, Annual Report for the preceding year and/or Credit lines/bank guarantees/deposits ( for juridical entity)  Sworn Statement of Assets and Liabilities, Income Tax Return and Credit lines/bank guarantees/deposits (for individual)
  7. Affidavit of Undertaking (using MGB form)
  1. Other Requirements:
  1. Secretary’s Certificate attesting to a Board Resolution regarding the authorization of the company’s authorized signatory (for juridical entity only)
  2. Certificate   of   Satisfactory    Environmental   Management and Community Relations Record (CEMCRR) or Certificate of Exemption from the CEMCRR
  3. Environmental Work Program (MGB Form 16-1 or 16-1A), duly prepared, signed and sealed by a licensed Mining Engineer or Geologist
  4. Area Status and Clearance from the One Stop-Shop Committee
  5. Proof of payment of Clearance Fee (P5,000.00)
  6. Proofs that the Notice of Application was –

6.1.  Published once in –
6.1.1.   Local newspaper
6.1.2.   National newspaper

6.2 Posted for 1 week on the bulletin boards  of

6.2.1.   MGB Regional Office(s)
6.2.2.   Province(s)
6.2.3.   Municipality(s)
6.3. Radio announced daily for 1 week in a local radio program            

  1. Certification from the Panel of Arbitrators (PA) concerned as to any adverse claim/protest/opposition
  2. NCIP Certificate of Non-Overlap/Certification Precondition
    1. For non-ICC/IP area: Certificate of Non-Overlap by NCIP RO or FBI Report pursuant to  DAO No.2007-15
    2. For ICC/IP area: Certification Precondition by NCIP CO and/or  Free and Prior Informed Consent/MOA pursuant to DAO No. 2007-15
    3. For private lands: proof of ownership, such as Original Title/ Transfer Certificate of Title, among others
