Engineer Daniel S. Belderol, Officer-In-Charge of the Mines and Geosciences Bureau-X addresses varied issues and concerns relative to the levelling-off on the different Procedures and Process flow of Locally issued Permits in Region X.

The Mines and Geosciences Bureau X hosted a one day activity geared towards the Levelling-Off on the Procedures/Process Flow of Locally-Issued Permits last July 22, 2019.  It was attended by twenty seven (27) participants representing the five Provinces of Misamis Oriental, Lanao del Norte, Bukidnon, Misamis Occidental and Camiguin, including the two (2) chartered Cities of Cagayan de Oro and Iligan.

The said activity was anchored on the primary objective of proposing and attaining a standardized process flow of locally-issued permits for a systematic and uniform process based on a consolidated standard process flow. The Mines and Geosciences Bureau Regional Office No. X hosted the 4-day 3rd Management Conference last June 24-27, 2019 held at the N Hotel, Kausawagan Highway, Cagayan de Oro City.  The conference was a convergence  of MGB Regional Directors and the different Division Chiefs from the MGB CentraL Office respectively.

This  2019 3rd Management Conference was centered on the discussion on the following major concerns:

  • Review and Status Updates of the Agreement of the Previous Management Conference
  • Matters Concerning Mineral Production Sharing Agreement (MPSA)  and other Tenements
  • Recommendation on Addressing Issues/Concerns Related to Expansion of Contract Areas

A new set of Clarificatory Guidelines on the Industrial Sand and Gravel Permit was issued on April 10, 2019 after the conduct of the 2019 National Workshop and Conference on the Proposed Revision of the Department of Environment and Natural Resources Administrative Order No. 2010-21 and other Related Matters   from April 1-6, 2019 held at the Greenhills Elan Hotel Modern in Greenhills, San Juan City.

The said Conference was attended by all the Regional Division Chiefs of the Mine Management Division, Mine Safety, Environment and Social Development Division and respective Regional lawyers of the Mines and Geosciences Bureau.

The New Set of Clarificatory Guidelines for ISAG is embodied under MGB MEMORANDUM CIRCULAR NO. 2019-001 issued on April 10, 2019.

Pursuant to Section 9 of Republic Act (RA) No. 7942, The Philippine Mining Act of 1995; Section 8 of Department of Environment and Natural Resources Administrative Order (DAO) No. 2010-21, the Revised Implementing Rules and Regulations of RA No. 7942; and Executive Order No. 292, otherwise known as the Administrative Code of 1987, pertaining to the power of the Director of a line Bureau to promulgate rules and regulations necessary to carry out bureau objectives, policies and functions on the coverage of Industrial Sand  and Gravel Permits (ISGP) and transport of sand  and gravel materials  therefrom are hereby issued.


This shall cover existing and new/pending applications for ISGP


Existing ISGP with mineral processing facilities located outside of the extraction area shall be allowed which shall form part of the Permit Area as parcel 2: Provided, that the combined area shall not exceed the allowable maximum area of twenty (20) hectares pursuant to Section 72.b of DAO No. 2010-21.


A Dispatched Receipt of (ANNEX A) shall be required for the transport of the sand and gravel materials beyond the one (1) kilometer distance from the extraction area to the mineral processing facility. Mineral Processing Facilities that are located within 1 km distance from the extraction area shall be exempted from issuance of Dispatch Receipt.

For commercial disposition of sand and gravel materials, Delivery Receipt (DR) shall be required in accordance with Section 117 of DAO No. 2010-21, DAO No. 2008-20, DENR Memorandum Order (DMO) No. 2008-04, DMO No. 2009-01, and DMO No. 2019-07.


  1. For existing permits:
  1. Revised location map/sketch  plan of the proposed permit area showing the location of the extraction  area, mineral processing facility and designated transport route;
  2. ECC covering the processing facility; and
  3. Consent of or Lease Agreement with landowners
  1. For new/pending applications, the requirements under Item a above shall be complied with in addition to Section 74 of DAO No. 2010-21.


The Regional Office concerned shall notify all existing ISGP holders and applicants to comply with the provisions of this Circular within thirty (30) days from receipt of the notice.

The Provincial/City Mining Regulatory Board concerned shall issue its own Clarificatory guidelines on ISGP for processing facilities outside the permit area.


This Memorandum Circular takes effect immediately and shall remain in force in effect unless revoked/repealed in writing by this Office.

A new set of the National Mines and Geosciences   Bureau Employees Association  (MGBEA) was elected and inducted during the 16th MGBEA National Convention  and 7th MGBEA National Congress last April 22 – 25, 2019 held at the Microtel , UP Techno Hub, Quezon City.

This Mineral Processing permit issued last April 2, 2019 denominated as MPP No. 2019-05-X is the first MPP approved by MGB X for the Year 2019 with Crushing Plant located in Brgy. Dioyo, Sapang Dalaga, Misamis Occidental.  Commodity for the said MPP is sand and gravel and other aggregates with a total capacity of 120,000 metric tons per year based on their  Environmental Compliance Certificate (ECC) issued by the Environmental Management Bureau X.

Moncano dated September 21, 2018, and   as per order from the DENR Secretary Roy Cimatu.

The suspension was in view of the recent landslide incidents in Itogon, Benguet and Naga City, Cebu that resulted to the deaths and missing persons, and damages to properties of communities near mining/quarry operations. The secretary has instructed identified MGB Regional Offices to conduct an immediate safety inspection and Geohazard assessment of the communities near the mining/quarry operations under their area of jurisdiction to prevent similar landslide incidents.  Continue reading »

Fifty (50) participants from the  different PENROs/CENROs including  embedded  personnel,  representatives from  DENR , EMB and some MGB X technical personnel   converged during the  Orientation Seminar on the Guidelines in the conduct of Apprehension, Seizure, Confiscation and Dispostion of illegally  sourced Minerals/Mineral Products  and By-Products, Tools, Conveyances and Equipment used provided under MGB MC No. 2018-01 conducted on August 24, 2018 at the  Philtown Hotel and Restaurant .

The Seminar was aimed to orient the participants on the updated policy guidelines in the apprehension, confiscation and disposition of illegally sourced minerals as provided  under  MGB Memorandum Circular No. 2018-01 and as  presented by Atty. A one day  Orientation Seminar/Learning Activity was conducted for members of Multi-partite Monitoring  Teams (MMTs) from  Iligan City and Misamis Oriental.  The activitry was designed to orient new members on pertinent environmental and mining laws, rules , regulations and programs covering the topics on the following:

  • Evironmental Impact Statement System
  • Ecological Solid Waste Management
  • Toxic substance, Hazardous and Nuclear waste Control
  • Clean Air Act and Clean Water Act
  • Ambient Air Sampling Procedure
  • Adjudication of Environmental Compliance Certificate  (ECC) Violations and Pollution Cases
