ENDORSEMENT OF MINERAL PRODUCTION SHARING AGREEMENT

Purpose

Issuance of the MOEP necessary for the transport/shipment of mineral ores, including tailings, outside the Philippines. Provided, that all first-time MOEP applications shall not be accepted.

Scope

The process starts with the receipt of application for the MOEP and ends with the issuance of the MOEP.

Input

  • MOEP application form together with the mandatory requirements (3.2) pursuant to DENR Administrative Order (DAO) No. 2008-20 Section 3.
  • MOEP Requirements
    • Original and duly accomplished MOEP application form under DAO No. 2008-20;
    • OTP or delivery receipt in the case of sand and gravel permit holders;
    • Marketing contract/sales agreement with the purchaser;
    • Copy of the permit/contract issued to the permit holder/ contractor, and/or accreditation of traders, retailers, processors, whichever is applicable;
    • Other supporting papers as the secretary may require or the applicant may submit.
    • A request letter for shipment validation and upon payment of the required verification fee.

ISSUANCE OF CERTIFICATE OF ACCREDITATION

Purpose

Issuance of Certificate of Accreditation necessary for the trading of minerals/mineral products and by-products either locally or internationally by Processors, Traders, Dealers and Retailers who are not Contractors/Permit Holders/mining right holders.

Scope

The process starts with the receipt of application for Accreditation of Processors, Traders, Dealers and Retailers who are not Contractors/Permit Holders/mining right holders in the trading of all minerals and ores including construction materials such as raw sand, gravel, wash out pebbles and filling materials, semi-processed mineral products such as, but not limited to rock, concrete aggregates, unpolished decorative stone (such as marble, granite or limestone), tiles and slabs, metallic ore concentrates/tailings, smelter slags, cathodes, ingots, billets, blooms, unrefined precious metals/bars/ bullion and agricultural/industrial lime; and ends with the issuance of the Certificate of Accreditation.

Input

  • Through submission of the Application Form for Accreditation together with the mandatory requirements (3.2) and upon payment of the required fees (3.3) pursuant to DENR Administrative Order (DAO) No. 2010-21 Section 129 and DAO No. 2005-08 Section 1.6.
  • Accreditation Requirements
    • Duly accomplished Application Form as prescribed in MGB Form No. 13- 1;
    • Copy of the Permit/Contract of the Suppliers/sources of minerals/mineral   products/by-products or copy of Certificate of Accreditation in case the source of materials is a trader, dealer or retailer;
    • DTI Registration;
    • Proof of legal source or supply as supported by any of the following documents:
    1. Supply Contract/ Agreement with a Permit Holder/ Contractor/accredited dealer producing the specified minerals/ mineral products/ by-products;
    2. Affidavit executed by a Permit Holder/ Contractor/accredited dealer to the effect that it is willing or currently selling and will continue to sell or supply the applicant with the minerals/mineral products/by-products specified in the application;
    3. Delivery or Purchase Receipts issued by a Permit Holder, Contractor or previously accredited dealer/trader; and
    4. OTP or Bill of Lading which clearly indicates that the applicant is the consignee of a Permittee or a duly accredited dealer/trader/shipper; v. Other supporting papers as the Regional Office (RO) concerned may require or the applicant may submit.
  • Fees and Charges
    • Filing Fee of Php5,000.00/ application;
    • Renewal fee of Php2,500.00/ application.

Guidelines (Criteria)

ISSUANCE OF EXPLORATION PERMIT

Purpose

Initial evaluation, endorsement for approval to MGB-Central Office (CO) of the EP application and issuance of the EP.

Scope

The process starts with the receipt of the application and ends with the issuance of the EP to the mining clientele.

Input

  • Through submission of the EP application form together with the complete mandatory requirements (3.2) pursuant to DENR Administrative Order (DAO) No. 2010-21.
  • Mandatory requirements in the acceptance of application:
    • Application Form (MGB Form No. 6-1);
    • For Corporation/ Partnership/ Association/ Cooperative: SEC/ CDA-Certified Certificate of Registration, Articles of Incorporation/ Partnership/ Association and By-Laws; or a Certification from MGB CO/Regional Office (RO) concerned that such documents are duly registered in that office (Note: with minimum authorized capital of P100M and paid-up capital of P6.25M);
    • Location Map/Sketch Plan (1:50,000 NAMRIA Topographic Map) showing coordinates/ boundaries (in tabulated form) with major environmental features/ other projects (prepared, sealed and signed by a Deputized Geodetic Engineer);
    • Two (2)-Year Exploration Work Program (MGB Form No. 5-4);
    • Proof of Technical Competence in the form of:
    1. Bio-data and track records in mining operations/ environmental management
    2. Sworn statement of the technical person(s) who will undertake the implementation of the work programs or employment contract/proof of availed service(s);
    • Proof of Financial Capability:
      • For an Individual:
      1. Statement of assets & liabilities duly sworn in accordance with existing laws
      2. Latest Income Tax Return
      3. Credit Lines/Bank Guarantees/Deposits of at least P2.5m;
      • For Corporation/ Partnership/ Association/ Cooperative:
      1. Latest Audited Financial Statements
      2. Annual Report for the Preceding Year
      3. Credit Lines/Bank Guarantees/ Deposits;
    • Affidavit of Undertaking (using MGB Form)
  • Other Requirements:
    • Board Resolution regarding the authorization of the company’s authorized signatory;
    • Certificate of Environmental Management and Community Relations Record (CEMCRR) or Certificate of Exemption
    • Environmental Work Program (MGB Form No. 16-1 or 16-1a), duly prepared, signed and sealed by a licensed Mining Engineer or Geologist;
    • Area Status and Clearance from the One Stop-Shop Committee;
    • Proof of payment of Clearance Fee (P5,000.00);
    • Proofs of publication, posting and radio announcement of the notice of application;
    • Certification from the Panel of Arbitrators;
    • Proof of Consultation with the concerned Sanggunians;
    • NCIP Certificate of Non-Overlap/Certification Precondition.

The output for this process is the endorsement of the EP application to MGB-Central Office and the issuance of the EP.

ISSUANCE OF INDUSTRIAL SAND AND GRAVEL PERMIT

Purpose

Issuance of the Industrial Sand and Gravel (ISAG).

Scope

The process starts with the receipt of application and ends with the issuance of the ISAG.

Input

  • Through submission of the  application form together with the mandatory requirements (74)  and upon payment of the required fees pursuant to DENR Administrative Order (DAO) No. 2010-21.
  • ISAG Requirements
    • Location map/sketch plan of the proposed permit area showing its geographic coordinates/ meridional block(s) and boundaries in relation to major environmental features and other projects using NAMRIA topographic map in a scale of 1:50,000 duly prepared, signed and sealed by a deputized Geodetic Engineer;
    • Area clearance from the Government agencies/LGUs concerned that may be affected by the permit application or written permission from the landowner(s) and surface owner(s) of the area applied for;
    • Work Program (MGB Form No. 5-4 or MGB Form No. 6-2) duly prepared, signed and sealed by a licensed Mining Engineer or Geologist;
    • An application (MGB Form No. 16-04) for or a CEMCRR.
    • ECC prior to extraction, removal and/or disposition and EPEP (MGB Form No. 16-2) as provided for in Section 169 hereof;
    • Proof of technical competence including, among others, curricula vitae and track records in mining operations and environmental management of the technical personnel who shall undertake the activities in accordance with the submitted Work Program and EPEP;
    • Proof of financial capability to undertake the activities pursuant to Work Program and EPEP, such as the following:
      • For Individuals:
        • Statement of assets and liabilities duly sworn in accordance with existing laws, credit lines and income tax return for the preceding three (3) years and
      • For corporations, partnerships, associations or cooperatives:
        • Latest Audited Financial  Statement and where applicable, Annual Report for the preceding year, credit lines, bank guarantees and/or similar negotiable instruments.
    • Photocopy of Articles of Incorporation/ Partnership/Association, By- Laws and Certificate of Registration, duly certified by the SEC or authorized Government agency(ies) concerned, for corporations, partnerships, associations or cooperatives; and
    • Other supporting papers as the Regional Office/Provincial/City Mining Regulatory Board concerned may require or the applicant may submit application Sand and Gravel Permit (MGB Form No. 8-3A),
  • Fees and Charges
    • Filing Fee of Php10,000.00/ application;
    • Renewal Fee of Php10,00.00/ application;
    • Transfer Fee of Php10,000.00/ application.

ISSUANCE OF MINERAL PROCESSING PERMIT

Purpose

Issuance of the MPP necessary for the processing of mineral ores whose project cost is Two Hundred Million Pesos (PhP200,000,00) or less.

Scope

The process starts with the receipt of application for the MPP whose project cost is PhP 200,000,00 or less and ends with the issuance of the MPP.

Input

  • Through submission of the MPP application form together with the mandatory requirements (3.2) and upon payment of the required fees (3.3) pursuant to DENR Administrative Order (DAO) No. 2010-21 Chapter XI and DAO No. 2005-08 Section 1.4.
  • MPP Requirements
    • Application (MGB Form No. 11-2) for MPP;
    • Duly certified Certificate of Registration issued by the SEC or authorized Government agency concerned;
    • Duly certified Articles of Incorporation/ Partnership/Association and By-Laws;
    • Location map/sketch plan of the area of the proposed processing plant using NAMRIA topographic map in a scale of 1:50,000;
    • Feasibility Study including work programs, plant site, mill and plant layout/design, details of technology to be employed in the proposed operation, anti-pollution devices/measures as well as the plant capacity: Provided, That an MPP applicant with existing mineral processing operation may submit, in lieu of the Feasibility Study, a Project Description and a detailed financial statement for its operations incorporating therein the social and environmental expenditures, taxes and fees paid (MGB Form No. 5-3A);
    • An application (MGB Form No. 16-04) for or a CEMCRR;
    • ECC;
    • Proof of technical competence including, among others, curricula vitae and track records in mineral processing and environmental management of the technical personnel who shall undertake the operation;
    • Proof of financial capability to undertake the activities pursuant to the Feasibility Study and EPEP,  such as latest Audited Financial Statement and where applicable, Annual Report for the preceding year, credit lines, bank guarantees and/or similar negotiable instruments;
    • Interim Importation Permit/certification from EMB on the use of chemicals (e.g. cyanide, mercury) in compliance with R.A. No. 6969;
    • Brief history of applicant’s activities for the last five (5) years, if any;
    • Supply Contract/Agreement with mining rights holders, if applicable; and
    • Other supporting papers as the Secretary/ Director/Regional Office (RO) concerned may require or the applicant may submit.
  • Fees and Charges
    • Filing Fee of Php10,000.00/ application;
    • Renewal Fee of Php10,00.00/ application;
    • Transfer Fee of Php10,000.00/ application.

ISSUANCE OF ORE TRANSPORT PERMIT

Purpose

Issuance of the OTP necessary for the transport of all minerals/mineral products and by products, including gold bullions.

Scope

It starts with the receipt of Ore Transport Permit Application for the transport of all minerals/mineral products and by products, including gold bullions by Permit Holders, Contractors, accredited Traders, Retailers, Processors and other mining rights holders and ends with the issuance of the Ore Transport Permit.

Input

  • Through submission of the OTP application form together with the mandatory requirements (3.2) and upon payment of the required fees (3.3) pursuant to DENR Administrative Order (DAO) No. 2010-21 Sections 116 and 117, and DAO No. 2005-08 Section 1.5, respectively.
  • OTP Requirements
    • Application Form (MGB 12-1) duly accomplished;
    • Copy of the mining permit/contract;
    • Other supporting documents such as award documents for ore acquired through bidding from Natural Resources Development Corporation (NRDC) and accreditation as mineral trader.
  • Fees and Charges
    • Php 1,000.00 (for non-metallic mineral);
    • Php 2,000.00 (for metallic mineral).
